Agreement to Terms
These Terms of Service ("Terms") govern your use of Crabtree Fisheries' services, website, and facilities. By making a booking or using our services, you agree to comply with and be bound by these Terms.
If you do not agree with any part of these Terms, you must not use our services or make a booking.
Definitions
- "Company," "we," "our," or "us"
- Refers to Crabtree Fisheries
- "Customer," "you," or "your"
- Refers to the person making the booking and any members of their party
- "Services"
- Refers to access to our fishing lake, facilities, and related services
- "Booking"
- A confirmed reservation for exclusive access to the lake for specified dates
Booking Terms & Conditions
Booking Process
- All bookings must be made through our official booking system or by direct contact
- A booking is only confirmed upon receipt of the required deposit
- Deposit required: 50% of total booking value
- Balance payment due 21 days before arrival date
- All payments must be received by the due dates to maintain your booking
Booking Confirmation
- Written confirmation will be sent via email upon deposit receipt
- Please check all details carefully and report any errors immediately
- Booking confirmations include important information about your visit
- You are responsible for ensuring all party members understand these terms
Pricing & Fees
- All prices are in British Pounds (GBP) and include VAT where applicable
- Prices may change without notice for future bookings
- Additional charges may apply for damages or rule violations
- Payment processing fees are non-refundable
Payment Terms
Payment Methods
- We accept major credit and debit cards through Stripe
- Bank transfers may be accepted for large bookings (contact us)
- Cash payments are not accepted for deposits or advance bookings
- All payments are processed securely and we do not store card details
Payment Schedule
- Deposit: 50% due at time of booking
- Full Payment: Required for bookings made within 28 days of arrival
- Balance: Remaining amount due 21 days before arrival (for bookings with deposits)
- Late Payment: Bookings may be cancelled if balance not received on time
Failed Payments
- Failed or declined payments may result in booking cancellation
- You are responsible for ensuring payment methods are valid and funded
- We will attempt to contact you if payment issues arise
- Additional fees may apply for failed payment processing
Cancellation & Refund Policy
Cancellation by Customer
More than 30 days before arrival: Full refund minus 10% administration fee
15-30 days before arrival: 50% refund
7-14 days before arrival: 25% refund
Less than 7 days before arrival: No refund
Cancellation by Crabtree Fisheries
- We reserve the right to cancel bookings due to unforeseen circumstances
- Full refund will be provided if we cancel your booking
- We will attempt to offer alternative dates when possible
- Our liability is limited to the refund of payments made
Refund Processing
- Refunds will be processed to the original payment method
- Processing time: 5-10 business days depending on your bank
- Processing fees are non-refundable
- Refunds are issued in the same currency as the original payment
Lake Rules & Conduct
All customers must comply with our comprehensive lake rules. Full details are available on our Lake Rules page.
Key Requirements
- Valid Environment Agency fishing license required
- Compliance with all catch and release policies
- Respect for other visitors, local residents, and the environment
- No alcohol or illegal substances permitted
- Quiet hours observed (10 PM - 6 AM)
Violations & Penalties
- Serious rule violations may result in immediate expulsion without refund
- Damage to property or facilities will incur additional charges
- Repeated violations may result in permanent ban from the facility
- We reserve the right to involve authorities for illegal activities
Liability & Insurance
Limitation of Liability
YOU FISH AND USE OUR FACILITIES ENTIRELY AT YOUR OWN RISK.
Crabtree Fisheries accepts no responsibility for injury, loss, damage, or death to persons or property occurring on our premises or as a result of using our services.
Customer Responsibilities
- You are responsible for your own safety and that of your party members
- Appropriate personal insurance is strongly recommended
- You must report any incidents or hazards immediately
- Swimming and entering the water is strictly prohibited
- Children must be supervised at all times
Property Damage
- You are liable for any damage caused by you or your party
- Repair costs will be charged at market rates
- Intentional damage may result in police involvement
- We reserve the right to charge reasonable cleaning fees
Privacy & Data Protection
We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to such processing.
Information Use
- Personal information used for booking management and communication
- Payment information processed securely through third-party providers
- Marketing communications only with your consent
- Information may be shared with authorities if required by law
Force Majeure
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, extreme weather, or flooding
- Government restrictions or regulations
- Pandemic or health emergencies
- Infrastructure failures or utility outages
- Acts of terrorism or civil unrest
In such cases, we will work with customers to reschedule or provide appropriate refunds based on the circumstances.
Intellectual Property
- All website content, photos, and materials are our property or used with permission
- You may not reproduce our content without written permission
- Photos taken on our premises may be used for our marketing purposes
- You grant us permission to use photos of your visit for promotional purposes
Governing Law & Disputes
Applicable Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Dispute Resolution
- We encourage customers to contact us directly to resolve any issues
- Most concerns can be resolved through good faith discussion
- Mediation may be used before resorting to legal proceedings
- You agree to first attempt resolution through our customer service
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted on our website. Continued use of our services after changes constitutes acceptance of new Terms.
For existing bookings, terms in effect at the time of booking will generally apply, unless changes are required by law or for safety reasons.
